Modern Group Website Membership Program Terms and Conditions

General
1. The Modern Group Website has free membership online which, from time to time, offers special bonuses, promotions and privileges (to be determined by MG in its absolute discretion) to members who register their details online at www.moderngroup.com.au or www.modernsolar.com.au.
2. These terms and conditions form the basis of the Modern Group Website Membership Program. Information on how to enrol, Registration and MGW Bonus Offers form part of these terms and conditions.
3. In these terms and conditions the following definitions apply:
  1. "MG" means the Modern Group Marketing and divisions of the Modern Group or its authorised representatives.
  2. "Participating MG branches" means those Modern Group branches from time to time participating in the membership program.
  3. "MGW" means the Modern Group Website.
  4. "MGW Bonus Offer" means any offer which, from time to time, will be made to members of the Modern Group Website Membership Program including, but not limited to, special offers, bonuses, promotions, and exclusive privileges.
  5. "Member" means an individual who registers as a member of the Modern Group Website Membership Program.
  6. "Membership" means a registered membership of the Modern Group Website Membership Program.
  7. "Program" means the Modern Group Website Membership Program.
  8. "Registration" means the act of entering details online by individuals for the purposes of becoming a member of the Modern Group Website Membership Program.
4. Employees and their immediate families, of MG, or its agents, contractors or franchisees, are ineligible to apply for a Membership.
5. The Program is conducted by Modern Roof Restoration (NSW) Pty Ltd of 1-3 Meridian Place, Norwest Business Park, Baulkham Hills NSW 2153, ABN 13 075 084 847.
Members
1. Customers who wish to apply for a membership must register online at www.moderngroup.com.au or www.modernsolar.com.au, and in doing so they agree to be bound by these terms and conditions. Only individuals may be Members and may only hold one membership at any one time. Registrations submitted for membership to be registered under the names of two or more individuals or by corporations will not be accepted.
2. By registering as a Member, unless otherwise advised, each Member also agrees that MG may use this information, in any media for future promotional, marketing and publicity purposes without any further reference.
3. Membership to the Program is only open to residents of Australia.
4. MG may reject or refuse any Registration at its discretion. MG reserves the right, at any time, to verify the validity of Registrations and Members (including a Member's identity, age and place of residence). Failure by MG to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. MG may cancel any Membership at any time without notice and for any reason, including (without limitation) if the Member: fails to comply with these terms and conditions; supplies any misleading information or makes misrepresentations to MG, any participating MG stores, or any MGW Bonus Offer provider; dies or becomes bankrupt; fails to comply with the terms on which any reward or promotion is offered under this Program; or abuses any privilege accorded to the Member under this Program.
6. A Member may terminate or cancel their MGW Membership at any time by emailing modernmembers@modernnsw.com.au
Receiving bonus offers based on Membership
1. To register as a Member and to be eligible to receive a MGW Bonus Offer customers must enter their details online. Once registered as a Member they will receive a confirmation email and begin to receive MGW Bonus Offers.
2. A Member cannot combine a MGW Bonus Offer with any other MGW or MG offers.
3. Unless otherwise specified, MGW Bonus Offers have no cash or monetary value and cannot be sold, transferred, assigned, or otherwise dealt with except in accordance with these terms and conditions.
4. MGW Bonus Offers will be determined by MG in its absolute discretion. If any MGW Bonus Offer (or part of any MGW Bonus Offer) is unavailable, MG, in its discretion, reserves the right to substitute the MGW Bonus Offer (or that part of the MGW Bonus Offer) with an offer to the equal value and/or specification.
Variation or change to Terms and Conditions
1. MG reserves the right to vary the terms and conditions of Membership, or suspend or terminate the Program at any time without prior notice.
2. Without limiting clause 8.1, MG may at any time in its absolute discretion and without notice, cancel Memberships, introduce an expiry date for use of MGW Bonus Offers or make any other change to membership privileges.
3. MG will endeavour to advise Members of information about promotions and other MGW Bonus Offers (such as any changes of the kind listed above), but MG will not be liable for any failure to do so.
Notice
1. Any notice to Members will be posted to the Member at the mail or email address appearing in MG records. Notices to MG shall be posted to PO Box 6765, Baulkham Hills or to modernmembers@modernnsw.com.au
Limitation of Liability
1. MG is not liable for: any delay in issuing a Membership; any use of a Membership by a person other than the Member and any benefits derived from the use of the Membership by that other person (such as the receipt of a MGW Bonus Offer); any correspondence between MG and the member lost or delayed in the mail or email; the suspension or termination of the Program; any disruption to the Program or any delay or inability to provide any MGW Bonus Offer caused by circumstances beyond the control of MG.
2. Any cost associated with accessing the website is the member's responsibility and is dependent on the Internet service provider used.
3. Except for any liability that cannot be excluded by law, MG (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Program, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the MG's control); (b) any theft, unauthorised access or third party interference; (c) any Registration or MGW Bonus Offer claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by MG) due to any reason beyond the reasonable control of MG; (d) any tax liability incurred by a Member; or (e) acceptance of a MGW Bonus Offer.
Privacy Policy
1. MG respects Members' rights to privacy under the Privacy Act 1988 and is required to comply with the national privacy principles in respect of the collection of personal information from individuals.
2. The personal information collected under the Program includes a Member's name, address, contact number(s) and email address which is required to enable MG to properly conduct the Program. It is optional for Member's to provide MG with any additional personal information contained in the Registration.
3. MG collects personal information in order to conduct the membership program and may, for this purpose, disclose such information to third parties, including, but not limited to, third party suppliers and as required, to Australian regulatory authorities. Membership is conditional on providing this information. MG may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the member.
4. MG adheres to a strict internal policy code to ensure that privacy is adhered to. MG warrants that will take all reasonable steps to protect personal information from misuse, loss and unauthorised access, modification or disclosure. Members may request access to their personal information at any time and may request MG to amend their personal records if they believe the information to be incorrect. Resolution of Disputes
1. Any question or dispute regarding the Program or in connection with member's participation in the Program will be resolved by MG in its sole discretion.
2. MG's decision on all matters pertaining to the Program, including but not limited to any dispute as to the identity of a Member, eligibility to become a Member or MGW Bonus Offers is final and binding. No correspondence will be entered into.
