Consumer:

To be eligible to enter, individuals must have purchased home improvements to the value of $500 or more in a single transaction from the Promoter. For every $500 invoiced for building projects during the Promotional Period, the individual will automatically be awarded one (1) entry into the Consumer Draw for the chance to participate in the Consumer Game to play to win $1,000,000.

Trade:

To be eligible to win a prize, individuals must first qualify to take part in the Monopoly Game. Individuals can qualify for the chance to take part in the Monopoly Game in one of the following ways:

  1. Three individuals will earn a place in the Monopoly Game by being the highest invoiced sales producer per product for Roofing, Shutters and Solar during the promotional period, as determined by the Promoter, in its absolute discretion; and
  2. Seven individuals will be chosen to participate in the Monopoly Game via a random draw ("the Trade Draw") - one entry into the Trade Draw will be awarded per $500 invoiced in a single transaction by each individual for the promotional period. The Promoter will award two entries into the Trade Draw per $500 invoiced in a single transaction for the promotional period in relation to any Self Generated Sales.

The winner of the Monopoly Game will then participate in the Trade Game and have a chance to play to win $1 million.

TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry into the Consumer element of the promotion is only open to Australian residents aged 18 years or over. Employees of the Promoter, participating retails and agencies associated with this promotion and their immediate families are ineligible to enter the consumer element of the promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    Entry into the trade element of this promotion is only open to the Modern and the Bramalco Group sales staff members who are Australian residents aged 18 years or over. Employees of the Promoter who are directly involved with the running of or administration of this promotion are ineligible to enter the trade element of the promotion.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. Multiple entries are permitted, however, only one entry will be permitted per qualified purchase or sale (except in the case of qualifying sales in the trade element of the promotion in relation to Self Generating Sales, where entrants will be allocated two entries into the Trade Draw).
  5. Entrants into the consumer promotion must be within the Promoter's trading terms throughout the promotional period and must not have overdue monies owing as at the closing date in order to be eligible to claim any prize.
  6. For the trade element of the promotion, all entrants must be employees of the Modern or the Bramalco Group at the time of the Trade Draw.
  7. Promotion commences on 01/02/09 and closes at 11:59pm AEDST on 31/01/10. The Trade Draw and the Consumer Draw will take place at Adrenalin, Level 1, 43 Booth St Annandale NSW 2038 on 12/02/10 at 3:00pm AEDST. The Trade Draw and Consumer Draw prize winners will be notified by mail and their names will be published in The Australian on 18/02/10. The Promoter's decision is final and no correspondence will be entered into.
  8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  9. Consumer Prize Draw:
    The first valid entry drawn in the Consumer Prize Draw will win a trip for 2 adults to Sydney, NSW valued at up to $4,000 depending on point of departure. Prize includes return economy airfares from the winner's nearest capital city (if required), 1 night twin share accommodation at Four Points Sydney, NSW including 1 dinner and 1 breakfast. If the winner is from NSW then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. Spending money, additional meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken on 26/02/10 to coincide with the Consumer Game and is subject to booking and flight availability. The Consumer Game is the promotional game conducted in accordance with these Terms and Conditions, whereby the prize winner will have the chance to play to win $1,000,000.
    Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.
    Trade Prize Draw:
    The first seven (7) valid entries drawn as well as the highest invoiced sales producer per product for Roofing, Shutters and Solar during the promotional period will win a trip for 1 adult to Sydney, NSW valued at up to $2,000 depending on point of departure. Prize includes return economy airfares from the winner's nearest capital city (if required), 1 night accommodation at Crown Plaza Norwest, Sydney NSW and one dinner and one breakfast. If the winner is from NSW then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. Spending money, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. These ten individuals will have the opportunity to participate in the Monopoly Game. Prize must be taken on 25/02/10 to coincide with the Monopoly Game and the Trade Game and is subject to booking and flight availability.
    Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.
    The Monopoly Game will be held on the 25/02/10 to decide one individual to participate in the Trade Game.
    The Monopoly Game will consist of 10 players selected by the following:
    • Three (3) Individuals will earn a place at the Monopoly Game by being the highest invoiced sales producer per product for Roofing, Shutters and Solar during the promotional period, as determined by the Promoter in its absolute discretion; and
    • Seven (7) individuals will be selected at random from the Trade Draw.
    The Monopoly Game will commence at 5pm AEDST on 25/02/10 and will be conducted in accordance with the standard rules of Monopoly (as set out in the instructions accompanying the standard game of Monopoly. If one individual holds all the Monopoly money at any one time, they will be deemed the winner, OR if at 12 midnight AEDST on 25/02/10, a result has not been achieved, the individual holding the most Monopoly money will be deemed the winner and will be eligible to play the Trade Game. In the event of a tie in the Monopoly Game, the winner will be determined by a random draw. Any dispute as to the rules and/or procedure of the Monopoly Game will be resolved by the Promoter, in its absolute discretion.
  10. The Trade Game and the Consumer Game are the promotional games conducted in accordance with these Terms and Conditions, whereby the winner of the Monopoly Game and the winner drawn from the Consumer Draw will have the chance to play to win $1,000,000.
  11. If a Participant cannot attend the Trade Game or the Consumer Game (whichever is applicable), the Participant may appoint a proxy over 18 years of age to play the game on his/her behalf provided the Participant gives the Promoter written notice to that effect before the start of the game. If the Promoter has not been able to contact a Participant before the start of the game, a representative of the Promoter will play the game on the Participant's behalf.
  12. The Trade Game and the Consumer Game will take place at The Modern Group, 1-3 Meridian Place, Baulkham Hills, NSW 2153 on Friday 26/02/10 at 1:00pm AEDST. There will be 250 numbered game pieces on display at the start of the game. One (1) game piece will contain a promotional message representing $1,000,000. The other 249 game pieces will each contain a promotional message representing $5,000. The game will be conducted twice (once for the trade element of the promotion and once for the consumer element of the promotion). The drawn Participant/ proxy / representative ("Attendee") must choose only one (1) game piece without touching, handling or interfering in any way with any of the other game pieces on display. If the Attendee is found to have breached this condition, he/she will be disqualified. If the Attendee selects the game piece containing the promotional message representing $1,000,000, then, subject to verification by the judges, the Participant (being the drawn winner from the Consumer Draw or the winner of the Monopoly Game from the trade element of the promotion, depending on the Attendee playing the game at the time) will win $1,000,000. If the Attendee selects a game piece containing a promotional message representing $5,000, then the $1,000,000 prize will not be given away and, subject to verification by the judges, the Participant (being the drawn winner from the Consumer Draw or the winner of the Monopoly Game from the trade element of the promotion, depending on the Attendee playing the game at the time) will win $5,000.
  13. When participating in the Trade Game or the Consumer Game, each Participant's odds of winning the $1,000,000 prize, is 1:250.
  14. The cash prizes will be awarded in the form of a cheque.
  15. Subject to the unclaimed prize draw, If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
  16. Total prize pool value is up to $1,004,000 (for the consumer element of the promotion) and up to $1,020,000 (for the trade element of the promotion). Prizes, or any unused portion of a prize, are not transferable or exchangeable.
  17. In the case of an unclaimed major prize, a draw may take place on 12/05/10 at The Modern Group, 1-3 Meridian Place, Baulkham Hills, NSW 2153 AEST, subject to any directions from a regulatory authority. Winners' names will be published in The Australian on 14/05/10. In the case of awarding a prize in the unclaimed prize draw, the winner, if any, will receive the trip to Sydney, equivalent to the original trip, and MAY also receive any unclaimed money that was won, but not claimed in the original Trade Game of Consumer Game (whichever is applicable depending on whether the unclaimed prize comes from the consumer or the trade element of the promotion).
  18. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) if a game is cancelled for any reason beyond the reasonable control of the Promoter; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
  21. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, profiling, research and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
